The Department of Economic Security (Department) received Governor’s Office approval to make revisions to 6 A.A.C.6, Article 8 - Programmatic Standards and Contract Monitoring for Community Residential Settings on May 24, 2024, and is currently in the rulemaking process. These rules govern how the Division of Developmental Disabilities (DDD) monitors Community Residential Settings and how Community Residential Settings are required to provide services to Members, train direct-support professionals, and provide structure within Community Residential Settings. During this rulemaking process, we welcome input from the public. To that end, we are requesting written comments on the current draft of these rules.
Amending these rules will allow the Department to clarify the rule’s applicability to include Group Home, Behavioral Supported Group Home, and Nursing Supported Group Home settings and remove references to both expired and out-of-date Department licensing rules that are now overseen by the Department of Health Services.
The Department is seeking informal stakeholder input as we draft these rules to ensure that we adequately consider stakeholders’ comments and concerns early in the rulewriting process. Although there will be an opportunity for formal public comment after the rules are published in the Arizona Administrative Register pursuant to A.R.S. § 41-1023, the Department will not be able to make any substantial changes to the draft rules at that time without additional steps and requirements to the rulemaking process.

Written comments are due by 11:59 p.m. Mountain Standard Time on Thursday, April 24, 2025. Written comments sent via the United States Postal Service must be postmarked by Monday, April 21, 2025, to ensure consideration. Please include the name and email address of the person providing comments as well as the name of any organization that person represents with the submission.
