The Department of Economic Security (Department) received Governor’s Office approval to engage in regular rulemaking for Arizona Administrative Code, Title 6, Chapter 6 (6 A.A.C. 6), Developmental Disabilities, Article 10 Child Developmental Foster Home License and Article 11 Adult Developmental Home License, and is currently in the rulemaking process.
These rules govern licensing requirements for child and adult developmental homes. The purpose of this rulemaking is to eliminate redundancy and the potential for confusion. Amending these rules will allow the Department to consolidate duplicative and eventually eliminate redundant and outdated rules associated with licensing and monitoring of adult and child developmental group homes. The proposed revisions will also allow the Department to address outdated terminology and update language to align with current practices, which will improve the clarity and effectiveness of the rules.
During the drafting process, we welcome input from the public, and are requesting comments on the current draft of these rules. Although there will be an opportunity for formal public comment after the rules are published in the Arizona Administrative Register pursuant to A.R.S. § 41-1023, as discussed above, the Department will not be able to make any substantial changes to the draft rules at that time without adding several additional steps and requirements in the rulemaking process. Therefore, the Department is seeking informal stakeholder input to ensure that we adequately consider stakeholders’ concerns early in the rulemaking process. Conforming to the formatting required by the Arizona Secretary of State, struck-through language represents language proposed to be removed from the existing rules, and underlined language represents language proposed to be added to the existing rules.
