The Department of Economic Security (Department) received Governor's Office approval to create rules which will govern the use of electronic monitoring devices in group homes, nursing-supported group homes, and intermediate care facilities. These new rules will be housed at 6 A.A.C. 6 Article 14. During the drafting process we welcome input from the public. To that end, we are requesting written comments on the current draft of these rules.
The Department originally published a Notice of Proposed Rulemaking (NPR) for these rules in the Arizona Administrative Register on April 22, 2022. As a result of comments we received about the NPR and new laws passed during the 2022 legislative session, the Department has engaged in a new rulemaking process in order to implement noted and required changes in the draft rules.
The Department is seeking additional informal stakeholder input as we draft these rules to ensure that we adequately consider stakeholders’ comments and concerns early in the rule writing process. Although there will be an opportunity for formal public comment after the rules are published in the Arizona Administrative Register pursuant to A.R.S. § 41-1023, the Department will not be able to make any substantial changes to the draft rules at that time without adding several more steps and requirements to the rulemaking process. Written comments are due by 11:59 p.m. Mountain Standard Time on Monday, September 30, 2024. Written comments sent via the United States Postal Service must be postmarked by Monday, September 30, 2024, to ensure consideration. Please include the name and email address of the person providing comments as well as the name of any organization that person represents with the submission.
